Terms of Use

These Terms are an agreement between you and Taras Grygorovych Shevchenko, private entrepreneur (FOP) (“Hahatron”, “we”, “us”) for the use of the Hahatron app, website and related services (the “Service”). They also serve as the end user licence agreement (EULA) for the app. By creating an account or using the Service you accept these Terms and our Privacy Policy.

1. Who can use Hahatron

You must be at least 13 years old, or the minimum age required in your country to use the Service without parental consent. If you are under 18, you confirm that a parent or guardian has agreed to these Terms. You may not use the Service if you have been banned from it before.

2. Your account

Keep your sign-in details secure and tell us if your account is compromised. You are responsible for activity on your account. You may delete your account at any time in the app.

3. Your content

You keep ownership of the videos and other content you post. By posting, you grant us a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, copy, transcode, display, distribute and promote your content in connection with operating, improving and marketing the Service — including showing selected videos, with credit to you, on Hahatron's own social media channels. This licence ends when you delete the content or your account, except for copies already shared by other users or held in backups for a limited time, and promotional posts already published.

You confirm that you own or have permission to use everything in your content (including music, people's likenesses and other people's work) and that it complies with these Terms and the law.

4. Community guidelines — zero tolerance

We do not tolerate objectionable content or abusive users. You must not post, share or promote:

• sexual content or nudity;
• any content that sexualises, exploits or endangers minors — we report it to the authorities and the National Center for Missing & Exploited Children (NCMEC) where applicable;
• graphic violence, cruelty to animals, or content promoting self-harm or dangerous challenges;
• hate speech, harassment, bullying, threats or content targeting people for who they are;
• illegal activities, weapons or drugs trading, terrorism or extremist content;
• spam, scams, misleading content, impersonation or manipulation of likes and views;
• other people's private information, or content that infringes copyright, trademarks or other rights.

Satire, parody and memes are welcome as long as they stay within these rules.

5. Moderation and enforcement

We check uploads with automated tools and human moderators. We may refuse to publish, remove or restrict content, issue strikes, and suspend or terminate accounts that break these Terms. Repeated violations lead to restricted or banned accounts. We will tell you what action we took and why, unless the law prevents it. If you disagree, you can appeal within six months by contacting nrg.ck.ua@gmail.com; a person will review the decision.

6. Reporting and blocking

You can report any video or user and block other users directly in the app. We review reports promptly and act on violations within 24 hours. To notify us of illegal content (including under the EU Digital Services Act), use the report button or write to nrg.ck.ua@gmail.com with the content link, why you believe it is illegal and your contact details.

7. Copyright

If you believe content on Hahatron infringes your copyright, send a notice to our designated agent at Taras Grygorovych Shevchenko, nrg.ck.ua@gmail.com (subject “Copyright notice”) including: your signature, the work you claim is infringed, the link to the infringing content, your contact details, a statement of good-faith belief, and a statement under penalty of perjury that your notice is accurate and you are authorised to act. Users whose content is removed may send a counter-notice. We terminate the accounts of repeat infringers.

8. Advertising

The Service is free and funded by advertising. Ads may appear between videos. Personalised ads are shown only with your consent where required.

9. Licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, in line with these Terms and the rules of the app store you downloaded it from. You must not copy, reverse engineer, scrape, or interfere with the Service or its security, or use it to build a competing service.

10. App store terms

If you downloaded the app from the Apple App Store: these Terms are between you and us, not Apple; Apple is not responsible for the app, its maintenance or support, or for any claims relating to it; if the app fails to conform to any applicable warranty you may notify Apple, which may refund the purchase price (if any), and Apple has no other warranty obligation; we, not Apple, are responsible for handling any intellectual property claims; you confirm you are not in a country subject to a U.S. embargo and are not on any U.S. list of prohibited parties; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Google Play's terms apply in addition if you downloaded the app from Google Play.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or end your access if you break these Terms, if required by law, or if we discontinue the Service; where reasonable, we will give you notice in advance.

12. Disclaimers and liability

The Service is provided “as is” and “as available”. Content is created by users and does not reflect our views. To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to USD 100. Nothing in these Terms limits liability that cannot be limited by law, or your statutory rights as a consumer.

13. Indemnity

To the extent permitted by law, you agree to compensate us for claims arising from your content or your breach of these Terms.

14. Changes

We may update these Terms. We will notify you of material changes in the app or by email before they take effect. If you keep using the Service after that, the updated Terms apply.

15. Governing law

These Terms are governed by the laws of Ukraine. If you are a consumer, you also benefit from the mandatory protections of the country where you live and may bring claims in its courts.
